Terms and Conditions

Arabella Rose Art / Five Six Studio Limited

Please read these terms carefully. They apply to any commission or purchase arranged with us. By using this website or placing an order, you agree to them.

1. About us

This website is a portfolio for Arabella Rose Art, a trading name of Five Six Studio Limited ("we", "us", "the Artist"), a company registered in England and Wales under number 14027794, with registered office at Apartment 1, 56 High Street, Knaresborough, HG5 0EA. You can contact us at hello@fivesix.studio.

Five Six Studio Limited is not VAT registered.

2. Definitions

"Artwork" means an original one-of-a-kind piece. "Commission" means an artwork created to a customer's specific brief. "Print" means a limited edition reproduction. "Order" means any commission or purchase agreed with us. "Completion" means an artwork is finished and ready for delivery or collection.

3. Enquiries and orders

This website is a portfolio. Prices are not shown; to commission or buy a piece, please contact us and we will provide a quote and, where relevant, a commission invoice setting out the specific terms of your order.

Once you place an order, you are responsible for making sure its details are complete and accurate, and for telling us straight away if anything is wrong. We are not responsible for inaccuracies in an order you have placed.

All artworks are made by hand, so each is unique and subject to natural variation. Colours may differ slightly from images shown here due to your display and to the materials and mixing involved. Where a commission is based on specific colours, Pantone references must be provided so we can match as closely as possible, though an exact match cannot be guaranteed.

4. Prices and payment

A commission fee is based on the estimated time, size, complexity and cost of materials, and is confirmed in your commission invoice before work begins.

For commissions, a non-refundable deposit of 50% is required before work starts, with the balance due on completion. Any other pieces are paid for in full as agreed at the time of order.

You do not own an artwork until we have received payment in full. If payment is overdue, interest of 10% per month may be charged on the outstanding amount. You will be invoiced by us directly, even where you were referred to us through a third party.

5. Framing

Framing is not included unless agreed in writing. Any framing is carried out by a third party and billed separately. Framed standard-size pieces come with a pre-assembled hanging cord. Larger frames need hanging mechanisms suited to the wall type and weight, and we recommend a competent joiner measures, weighs and hangs the work, checking the area is clear of pipes and wires. We are not responsible for damage to walls or artwork caused by incorrect hanging.

6. Delivery and collection

Unless otherwise agreed in writing, you are responsible for arranging delivery. We can arrange delivery for an additional fee. You are responsible for transit insurance, and we recommend using a highly rated specialist art courier.

Collection is currently available from Pictures Plus (Leeds, UK), Five Six Studio (Knaresborough, UK) and Dicasa (Gorey, Jersey). Once collection has taken place, we are not responsible for any damage in transit.

7. Timescales

Commission completion dates are agreed with you individually. We will tell you as soon as possible about any delay and put it right promptly. No compensation is given for delays outside our control, such as supply chain issues, missing deliveries or stock shortages.

8. Cancellations and returns

Commissions and original artworks are personalised, one-of-a-kind pieces made specifically for you. A commission may be cancelled up to 28 days before its agreed completion date by clear written statement (email or post); the 50% deposit is non-refundable unless we agree otherwise in writing at our discretion. Once a piece has been delivered and accepted on inspection, it cannot be returned.

Any issue raised on inspection that is reasonable and in line with the order description will be put right within 28 days.

9. Copyright

We retain copyright in all works we create, including commissions. Buying an artwork gives you ownership of the physical piece, not the right to reproduce it. A certificate of authenticity is provided with each original, confirming it as a one-of-a-kind, authentic and original work.

10. Website use

This site and its content - images, text and designs - belong to us and may not be copied or reused without permission. We aim to keep the site accurate and available but do not guarantee it will always be error-free or uninterrupted.

11. Complaints and disputes

We want to avoid disputes. If a problem arises, please contact us at hello@fivesix.studio and we will aim to respond with an appropriate solution within 10 working days.

These terms are governed by the law of England and Wales. Disputes are subject to the courts of England and Wales, or, if you live in Scotland or Northern Ireland, the courts of that country.
